Membership Terms & Conditions

This Membership Agreement is made between Leisuredome Gym ABN 41 256 952 826  ("Leisuredome", "we", "us" or "our") and the individual named in the Membership Application ("you" or "your").

Together, your Membership Application, these Terms & Conditions, our Gym Rules, the Pre-Exercise Questionnaire included in the Sign-up form, and any waivers you complete during the joining process form the entire agreement between us ("the Agreement").

By becoming a member, you agree to use our facilities and services in line with this Agreement.

1. Membership Types

We offer the following types of Membership:

Membership types contain either a 12-month minimum term or are deemed "no commitment" (no minimum term).

2. Joining and Access

To set up your membership, we'll need some personal details from you and a valid form of photographic identification. This helps us confirm your identity and keep our club safe for all members.

2.1. Agreement Start Date

Your membership begins on the date you sign this Agreement, unless we've agreed in writing to a different start date.

3. Minimum Age

  • For safety and security, you must be at least 14 years old to join as a member.
  • If you are under 18, a parent or guardian must sign all membership documents.
  • If you are 14 to 15 years old, you cannot access weight-training areas whilst unsupervised by a parent or guardian.
  • We may place further restrictions on access or activities at any time if we believe it is necessary for your safety.
  • Your parent or guardian:
    • accepts full responsibility for your actions, safety, and any damage, injury, or loss caused while you are in the gym (whether supervised or unsupervised), and
    • agrees to ensure your membership fees and any other charges are paid on time.

We may cancel your membership immediately if you do not comply with these age-related conditions.

4. Cooling Off Period

If you change your mind after joining, you have a 24-hour cooling-off period. To cancel during this time, you must notify us in writing or in person. If you do, we will:

  • refund any prepaid or up-front membership fees, and
  • deduct the cost of any services you've already used.

5. Your Health and Safety

5.1. Your Responsibility for Your Health

When you join and every time you use the gym, you must be confident that you are in suitable physical condition and have no medical reason to avoid exercise. If you're unsure, you should not use the gym until you've sought professional medical advice and been cleared to exercise.

You agree to:

  • provide us with all relevant health and fitness information before and during your membership,
  • complete our Pre-Exercise Questionnaire, and
  • seek medical clearance if your responses indicate it's required.

You understand that our screening is not a substitute for medical advice and cannot guarantee against injury or death.

You also promise that all information you give us is true, accurate, and not misleading.

You must not use the gym if you have any illness, injury, condition, or disease that could put your health or the health and safety of others at risk.

We may suspend or cancel your membership if we believe you have not complied with this clause.

6. Fees

6.1. General Payment Terms

Your membership fees and any other applicable charges have been explained to you when you selected your membership type, and are also set out in this Agreement.

If you miss a payment:

  • your membership may be suspended, and you may be refused access to the gym until all overdue amounts are paid.
  • if any fees remain unpaid for 28 days or more, your membership may be terminated, and
  • you will still be responsible for paying all outstanding amounts owed.

6.2. Membership Fees

Pre-Paid Membership (Fixed Term):

If you have chosen a Pre-Paid Membership, your full membership fee must be paid upfront when you sign or renew this Agreement.

Standard Membership (Ongoing with Minimum Term):

If you have chosen a Standard Membership, your fees are payable monthly in advance until your agreement ends. This agreement will continue automatically unless cancelled in line with clause 12.2.

6.3. Late or Missed Payments

If you don't pay a fee or other amount owing on time, we may suspend your membership until the account is brought up to date. This is in addition to any other rights we have under this Agreement.

Please note:

  • extra fees or charges may apply for late or rejected payments (see clause 7.2), and
  • membership fees will continue to accrue during any suspension.

6.4. Changes to Fees

We review membership and other fees from time to time and may adjust them at our discretion. If your fees are going to increase, we will give you at least 60 days' written notice.

Please note:

  • this notice period does not apply if you are simply renewing a Pre-Paid (Fixed Term) Membership, and
  • If you do not agree to the increase, you may cancel your membership.

If your fees change, you authorise us to adjust any scheduled debits from your nominated account accordingly.

6.5. Refunds and the Credit Code

We can deduct all Fees and charges that you must pay under this Agreement from any refund we give you.

7. Direct Debit

7.1. Payment by Direct Debit

If you pay membership fees or other charges by direct debit, the payments will be processed by our third-party billing provider  ("Biller"), not directly by us.

  • You will receive a copy of the Biller's Direct Debit Payment Agreement, which is separate from this Agreement and applies only to the debit service.
  • By providing your bank or card details, you authorise the Biller to deduct all fees and charges you are responsible for under this Agreement.
  • You must ensure your payment details are accurate and kept up to date.

Transaction Fees:

  • Bank account (BSB & Account Number): $0.00 per transaction
  • Visa & MasterCard: 0.00% of the transaction amount

7.2. Late or Rejected Direct Debit Payments

You are responsible for making sure there are sufficient funds in your nominated account on the scheduled payment date (or the next business day if banks are closed).

If a payment cannot be processed (for any reason outside the Biller's control):

  • a $15.00 administration fee  will be charged by the Biller and added to your next debit,
  • any overdue amounts may also be included in the next debit, and
  • you authorise the Biller to recover any unpaid arrears from your account.

Please note: your bank or credit provider may also charge you fees if your account is overdrawn or a payment is declined.

8. Pausing Your Membership

You can place your membership on hold ("freeze") if your account is up to date. The rules are as follows:

Standard Hold:

  • You may freeze your membership for a minimum of 2 weeks or to a maximum of a quarter of the period remaining on your Membership.
  • Freezes cannot be backdated, and they are not available during the notice period of a cancellation.

Medical Hold:

  • If you are temporarily unable to train due to illness or injury, you may freeze your membership for up to 3 months in any 12-month period.
  • You must provide supporting medical documentation to our reasonable satisfaction.
  • No hold fees apply for non-approved medical holds.

How to Request a Hold:

Important: While your membership is on hold:

  • your minimum term will be extended  by the length of the hold, and
  • direct debit payments will be paused  during the hold period.

9. Changes to Membership Type

Switching from Standard → Pre-Paid:

You are able to pay out the remaining amount for the current Standard Membership term. After this, you may then pay for the pre-paid term of your choice.

Switching from Pre-Paid → Standard:

  • You can only move to a Standard Membership after your Pre-Paid term has ended.

Refunds for Pre-Paid Members:

  • If you paid upfront for a Pre-Paid Membership, and you have a change of mind regarding the term for which you paid, you may only receive a refund for this amount within 24 hours of payment.

How to Request a Change:

10. Conduct

10.1. Safe Use of Equipment

You agree to use all equipment carefully and responsibly. If you are unsure how to use something, you must ask a staff member for guidance before using it.

10.2. Appropriate Attire

For safety and hygiene, you must wear suitable gym clothing at all times while using the facilities.

  • Footwear: Only athletic shoes (such as runners or sneakers)  are permitted. Footwear such as hard-soled shoes, dress shoes, sandals, thongs, open-toe footwear or work boots  (including construction or steel-cap boots) are not allowed in training areas.
  • Clothing: Clothing must be appropriate for exercise and must not be overtly offensive to other members or unsafe for training.

We reserve the right to refuse entry or ask you to leave if you are not wearing appropriate attire.

10.3. Guests

You're welcome to bring a guest to the gym, provided they:

  • Arrive with the intention to train and not to loiter
  • register with our staff on arrival,
  • pay the casual visit fee, and
  • meet our entry conditions (including being at least the minimum age, and completing our Pre-Exercise Questionnaire and any required forms).

10.4. Gym Rules

To make the gym a safe, respectful, and enjoyable place, all members and guests must follow our Gym Rules. These are displayed in the gym and form part of this Agreement. Common rules include:

  • Always return weights and equipment after use.
  • Wipe down equipment after use.
  • No negligent dropping or other misuse of equipment.
  • Use a towel during workouts.
  • No food or glass bottles on the gym floor.
  • Respect other members and staff — no abusive or antisocial behaviour.
  • All phone calls should be taken outside training areas.
  • Wear appropriate gym attire (see clause 10.2).

If you break the Gym Rules, we will respond in a way we consider fair and appropriate. For less serious issues, this may mean a warning. For serious breaches, or repeated breaches, we may suspend or cancel your membership.

If your breach causes us or anyone else loss, damage, or costs, you agree to cover those costs.

10.5. Music in the Gym

The music played in the gym is chosen at the discretion of the staff on duty. Staff are not required to change or adjust the music to suit individual member preferences.

If the music volume is unreasonably soft or loud, staff may adjust it at their discretion.

If the gym music is not to your taste, you are welcome to bring your own music, provided it is listened to only through personal headphones or earbuds  and is not audible to others.

10.6. Prohibited Substances

The use or distribution of illegal drugs, performance-enhancing substances, or any other illicit substances is strictly forbidden in or around the gym. You agree not to bring, use, or distribute such substances at any time.

10.7. No Unauthorised Commercial Activity

You must not carry out any business or commercial activity in the gym — for example, offering personal training services or selling products — unless we have given you prior written permission. Any permission we grant can be withdrawn at any time.

10.8. Risky or Inappropriate Conduct

You must not engage in risky, unsafe, or seriously inappropriate behaviour in the gym. Examples include (but are not limited to):

  • threatening, harassing, or intimidating others,
  • damaging equipment or property,
  • using or distributing prohibited substances, or
  • training other members without our approval.

If you engage in this type of conduct, we may take immediate action, which could include suspending or cancelling your membership  and/or referring the matter to the appropriate authorities.

If your actions cause us or anyone else loss, damage, or costs, you agree to cover those costs.

11. Security

11.1. CCTV Surveillance

The gym is monitored by 24-hour CCTV. Cameras may record you while you are in the gym, including when entering or leaving.

Recordings are used to:

  • maintain the security of the premises,
  • monitor equipment usage,
  • identify behaviour that may be unsafe to you or others, and
  • monitor locker areas to help reduce the risk of theft.

Signage is displayed throughout the gym to notify members that CCTV is in operation. Please note that CCTV is a monitoring tool only and does not guarantee your personal safety or the prevention of loss or theft of belongings.

11.2. Following Staff Directions

You agree to follow any reasonable instructions from gym staff relating to health, safety, security, or related matters. You should also take care when entering, leaving, and moving around the gym.

12. Termination of Agreement

12.1. Providing Notice

If you are required to give us notice in writing under this Agreement, you may do so either in person at the gym or by email to info@leisuredomegym.com.

12.2. Cancelling Your Membership

Standard Membership (Ongoing with Minimum Term):

  • To make sure your payments stop at the end of your Minimum Term, you must give us at least 14 days' written notice before the Minimum Term finishes.
  • If your membership has already rolled over beyond the Minimum Term, you can cancel at any time by giving us at least 14 days' written notice.
  • Your notice period starts on the date we receive your request.
  • Please note: you cannot place your membership on hold during your notice period.

Pre-Paid Membership (Fixed Term):

  • Your membership will automatically end when your Minimum Term finishes — you don't need to do anything.
  • We may contact you before the end of your Agreement to discuss renewal options.

12.3. Cancelling During Your Minimum Term

You may cancel your Standard Membership during the Minimum Term in the following circumstances:

  • Medical grounds — if you become seriously ill or incapacitated and cannot exercise for the remainder of your Minimum Term. You must provide a certificate from a qualified medical practitioner.
  • Breach by us — if we break an essential term of this Agreement and do not fix it within a reasonable time after you have asked us in writing.

What happens if you cancel:

  • For a Standard Membership (Ongoing with Minimum Term): A penalty fee will apply. However, in certain extenuating circumstances, this penalty fee may be waived.

12.4. When We Can End This Agreement

In addition to our other rights under this Agreement, we may cancel your membership if:

  • you breach an obligation under this Agreement that cannot be fixed,
  • you breach an obligation that can be fixed but do not correct it within a reasonable time after we ask you to,
  • your fees remain unpaid for 28 days or more, or
  • you have given us false or misleading details, or failed to tell us about changes to your health during your membership.

If we cancel your membership under this clause:

  • you remain responsible for all membership fees owing to the end of your Minimum Term, plus any fees for services already supplied, and
  • we may recover any costs, losses, or damages caused by your breach — including debt recovery expenses and legal costs — in addition to any other rights we have.

13. Changes to Your Agreement

From time to time, we may update this Agreement or our Gym Rules. If a change affects you in a significant or negative way and you do not agree with it, you will have the option to cancel your membership.

We will make reasonable efforts to:

  • let you know about any change in advance,
  • tell you when the change takes effect (normally at least 30 days' notice), and
  • explain how the change may impact you.

Please note: you cannot cancel under this clause if the change is required by law or by a direction from a relevant authority.

14. Privacy

By signing this Agreement, you consent to us collecting, using, disclosing, and handling your personal information in line with our Privacy Policy, which is available at: https://www.leisuredomegym.com/privacy-policy/. This includes consenting to the transfer and storage of your personal information outside Australia.

For the privacy and comfort of all members, photos and videos are not permitted in the gym  unless you have been given prior approval by staff.

15. Our Responsibilities and Limits

15.1. Statutory Guarantees

a) Under the Australian Consumer Law (ACL), we guarantee that the services we provide:

  • i. are delivered with due care and skill,
  • ii. are reasonably fit for any purpose you have told us you are using the services for or wish to achieve, and
  • iii. are supplied within a reasonable time.

b) Some laws allow us to limit how these guarantees apply.

c) By signing this Agreement, and to the extent permitted under section 139A of the Competition and Consumer Act 2010 (CCA), you agree that our liability to you for death or injury resulting from our failure to meet these guarantees is excluded or limited.

d) This exclusion does not apply if your death or injury is caused by our reckless conduct (as defined in the CCA).

15.2. Other Implied Terms

Nothing in this Agreement is intended to exclude, restrict, or modify any terms, conditions, warranties, guarantees, rights, or remedies that cannot be excluded by law.

For everything else:

  • unless specifically stated in this Agreement, any implied terms, conditions, warranties, guarantees, rights, or remedies that can legally be excluded are excluded; and
  • subject to clauses 18.1 and 18.2, we are not liable for death or injury caused by negligence  or for any breach of implied terms under common law that services will be provided with reasonable care and skill.

This exclusion does not apply to our reckless conduct.

15.3. General Release

You acknowledge that using the gym and its facilities carries inherent risks, including the risk of injury, whether caused by you or someone else. You agree to use the facilities at your own risk.

To the extent permitted by law, we are not liable for:

  • loss, damage, or theft of any property you bring onto the gym premises, or
  • any death, personal injury, or illness that occurs in the gym or arises from your use of our facilities or equipment.

15.4. Loss of Property

You agree not to bring unnecessary valuables into the gym. It is your responsibility to keep your belongings secure, and the gym is not responsible for unattended property.

While lockers are available, they are not completely secure — other members may still access or interfere with belongings left inside. If you leave items in a locker overnight, we may remove them.

Although locker areas are monitored by CCTV (see clause 11.1), this does not guarantee the safety of your belongings. We cannot accept responsibility for any loss or damage to your property while you are at the gym.

16. Your Responsibility for Damage

You agree to pay for any loss or damage to the gym caused by you or your guests through a wilful, wrongful, or negligent act, or as a result of a breach of this Agreement.

This responsibility does not  extend to normal wear and tear — for example, equipment parts (such as cables or upholstery) that have naturally worn down through regular and proper use.

17. Gym Closures

a) We may need to close the gym from time to time — for example, due to an emergency, by law or court order, or for refurbishment or relocation.

b) If the gym is closed for up to 14 days within any 30-day period, your membership fees will continue as normal.

c) If the gym is closed for 15 to 30 days within any 30-day period, your membership will be placed on hold at no cost and your Agreement will be extended for the same length of time.

d) If the gym is closed for up to 30 consecutive days due to refurbishment or relocation, the same freeze and extension in (c) will apply.

e) We will make reasonable efforts to let you know about any closure in advance, but this may not always be possible.

18. Feedback and Concerns

We value your feedback and take complaints seriously.

  • If you have any concerns about the gym or your membership, please raise them first with our staff.
  • If you feel uncomfortable doing so, or are not satisfied with the response, you may send your complaint by email to info@leisuredomegym.com
  • We follow the Fitness Industry Code of Practice. If you believe we have not complied with the Code, you may also lodge a complaint with Fitness Australia.
  • Events Beyond Our Control: We are not responsible if you cannot use the gym due to events outside our reasonable control (such as fire, flood, road closures, or similar disruptions). If this continues for more than 30 days, either you or we may cancel this Agreement by written notice, without penalty.
  • Government Restrictions: If the gym must close due to government restrictions, your Minimum Term will be extended  by the length of the closure, and direct debit payments will be paused  during that period.
  • Validity of Agreement: If a court decides that any part of this Agreement is invalid or unenforceable, that part will be removed, but the remainder will continue to apply.
  • Enforcement of Rights: If we do not enforce our rights under this Agreement at any time, it does not mean we waive those rights for the future.
  • Entire Agreement: You agree that no representations or promises have been made to you that are not contained in this Agreement.
  • Governing Law: This Agreement is governed by the laws of New South Wales.

20. Glossary

  • Agreement — includes these Terms and Conditions, the Gym Rules, your Membership Application, the Pre-Exercise Questionnaire, and any waivers you signed during the joining process.
  • ACL — the Australian Consumer Law within the Competition and Consumer Act 2010 (Cth).
  • Biller — our authorised third-party billing provider, currently EzyPay Pty Ltd (ABN 42 003 340 734).
  • Casual Fee — the fee for a single casual visit, currently $20.
  • CCA — the Competition and Consumer Act 2010 (Cth).
  • Gym — Leisuredome Gym, Beverly Hills, NSW 2099.
  • Gym Rules — the rules that apply to all members, as outlined in this Agreement and displayed in the gym (see clause 10.4).
  • Direct Debit Amount — the membership or other fees you authorise to be debited from your nominated account.
  • Direct Debit Payment Agreement  — the separate billing agreement you enter into with our Biller for direct debit services.
  • Essential Term — a key term of this Agreement that is so important you would not have entered into the Agreement without it. If there is a dispute about whether a term is essential, we will make a reasonable determination.
  • Fees — any fees payable under this Agreement, including Membership Fees.
  • Fixed Term Agreement — a membership that automatically ends at the end of its Term.
  • Member — a person who holds a current membership with the Gym.
  • Membership — another word for this Agreement.
  • Membership Fees — the fees you pay for your selected Membership Type.
  • Minimum Age — the minimum age to join and use the gym (see clause 3).
  • Minimum Term — the minimum commitment period for your membership (see clause 1), depending on your Membership Type.
  • Ongoing Agreement (Standard Membership)  — a membership that continues beyond the Minimum Term until it is cancelled in accordance with this Agreement.
